MIDDLETOWN — The trial begins this week for City Councilman A.J. Smith and the three women facing disorderly conduct charges following a scuffle over another man. Smith, 21, along with his sister, Elicia Smith, 20, Ashley Knight, 18, and Sherrell Knight, 22, will be on trial Monday, Aug. 16, on the charge of disorderly conduct. The case will be heard before Judge James Ruppert in Middletown Municipal Court at 1:30 p.m. Judge Mark Wall was excused from the case due to Smith’s role in city government. The charge stems from a July 14 incident in the 2000 block of Aaron Drive where police say they found Smith and the three women involved in a disturbance. According to police, it was instigated by a series of text messages between Ashley Knight and Elicia Smith over a man both women have a relationship with. According to the report filed by police Officer Deaton, who responded to the incident, he was willing to allow the parties to disperse with a warning but Smith insisted on each of them being issued a disorderly conduct summons. Smith later said he wanted them to be charged in the interest of justice for his sister. As a misdemeanor, the punishment for disorderly conduct if found guilty holds a minimum fine of $150 and no jail time up to $250 in fines and 30 days in jail, depending on the severity of the offense, according to court officials. He needs to go away!!!! We have enough issues going on and we do not need this kinda of stuff!!! Call for his resignation immmediately. |

smartman - Are you saying Smith needs to resign from council ??
Why ? Politicians are always in hot water for one thing or another. I don't think this is worth a resignation. Lets wait and see what happens at trial before we scream resignation.

I understand what your saying and your concern. To me it's pretty pathetic to be in that situation anyway just from texting which I think is ridiculous to begin with.
But I will give anyone the benefit of doubt. One of these days when the lid blows off the shady deals by city hall we are going to be known for a whole lot more.

AJ and the others wouldn't have been in this situation at all because the cop was just going to issue warnings. The story states that AJ insisted on all being charged to take it to court.
Just speculating here as to what AJ was thinking, but it would make sense to take this through the legal system by trial IF AJ thought the other people were a threat to his family- particularly his sister. He may have been thinking that the only way to prevent these people from harrassing his family is by legal means/restraining orders perhaps. Just guessing here. Obviously, only AJ knows what his motives are. He went the extra mile to insure that this was carried out as far as he could take it, risking more high profile while doing it. |

not sure what he was thinking because a misdemeanor conviction may affect his ability to get a job in a fire department...maybe, I don't know. |

Some of these city staffers commit crimes right in front of us twice a month (for example, the mysterious missing Exhibits B and C), yet folks want to maintain that they are innocent.
Nobody saw what happened with AJ. I, for one, will give him the benefit of the doubt and let the courts decide.

Well, it looks like the judge dismissed the case and told them all to grow up. Cost 'em 90 bucks in court costs to hear the case dismissed. If there is an on-going riff between these two parties, probably a good chance something else is around the corner. Two women fighting over a boyfriend can get the fists a swingin'.
Someone posted in the Journal that they thought AJ wanted this "out in the open" to avoid any mis-conceptions or coverups on his part. Maybe so. Might have been a good move, if true. Perhaps a restraining order by the judge to keep the parties away from each other??? Otherwise, we have another potential volatile situation, don't we? This appears to be a waste of the court's time. As Curly and the Three Stooges would say...."Thanks courty, you're a pal" |

Waste of time and our money! What did it cost the taxpayers to bring in an acting Judge and an acting Prosecutor?
