MOTION AGENDA

(a)    To concur with the Chief of Police to extend the hours for the Designated Outdoor Refreshment Area to include: September 10, 2016 from 12:00pm to 8:00pm for the Middletown Arts Festival.

COUNCIL COMMENTS

LEGISLATION

1. Resolution No. R2016-16, a resolution in support of the development of State and US Bicycle Routes as designated by the American Association of State Highway and Transportation Officials (AASHTO) and the Ohio Department of Transportation (ODOT) and declaring an emergency.

2. Resolution No. R2016-17, a resolution accepting the amounts and rates as determined by the Budget Commission and authorizing the necessary tax levies and certifying them to the County Auditor and declaring an emergency.

3. Resolution No. R2016-19, a resolution declaring the intent of the City of Middletown to appropriate three temporary easements, two perpetual easements to construct and maintain a sewer and two fee simple interests in certain real property owned by AK Steel Corporation and located at parcel numbers Q6542085000012, Q6542085000003 AND Q6542085000014, and declaring an emergency.

4. Resolution No. R2016-20, a resolution declaring the intent of the City of Middletown to appropriate a temporary easement in certain real property owned by Cynthia L. Tott located at parcel number Q6542115000041 and declaring an emergency.

5. Resolution No. R2016-21, a resolution declaring the intent of the City of Middletown to appropriate a perpetual easement to construct and maintain a sewer in certain real property owned by the State of Ohio located at parcel number Q6542039000200 and declaring an emergency.

6. Resolution No. R2016-22, a resolution declaring the intent of the City of Middletown to appropriate a temporary easement in certain real property owned by Mark and Thresea Robinson located at parcel number Q6542114000081 and declaring an emergency.

Resolution No. R2016-34, a resolution declaring the intent of the City of Middletown to appropriate three single sided billboard signs owned by Porter Advertising which are upon certain real property owned by the Baltimore and Ohio Railroad Company located at parcel numbers Q6542085000007 and declaring an emergency.

19. Resolution No. R2016-35, a resolution imposing a moratorium of six months on the issuance and processing of any permits allowing retail dispensaries, cultivators, or processors of medical marijuana within the City of Middletown and declaring an emergency.

20. Ordinance No. O2016-30, an ordinance establishing a procedure for and authorizing the purchase of an additional police canine and declaring an emergency.

21. Ordinance No. O2016-31, an ordinance establishing a procedure for and authorizing a contract with Andritz Separation for the replacement of missing tiles from the centrifuge conveyor and declaring an emergency.

22. Ordinance No. O2016-32, an ordinance authorizing the City Manager to create a pilot program to establish incentives to encourage the construction of deficient housing stock in the City and declaring an emergency.

23. Resolution No. R2016-18, a resolution authorizing an amendment to the employment agreement with Douglas Adkins to serve as City Manager of the City of Middletown. (2nd Reading)

ORDINANCE NO. O2016-32 
AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CREATE A PILOT PROGRAM TO ESTABLISH INCENTIVES TO ENCOURAGE THE CONSTRUCTION OF DEFICIENT HOUSING STOCK IN THE CITY AND DECLARING AN EMERGENCY. 
WHEREAS, the maintenance and construction of a balanced housing stock is critical to the economic health and well-being of the City; and WHEREAS, the City has a deficiency in new construction residential single family homes designed to both attract new residents to the City and keep our current residents in the City when they look for a new home; and 
WHEREAS, the City is interested in providing an incentive to develop a balanced housing stock to provide adequate residential opportunities to an ever diversifying population; and 
WHEREAS, the City has commissioned a housing study with results pending that will further delineate any deficiencies in homes in the City; and 
WHEREAS, the City would like to establish a pilot program for five (5) homes who are under contract before December 31, 2016 to determine if incentives will be helpful to stimulate the building of new construction homes in the Middletown School District; and 
NOW, THEREFORE, BE IT ORDAINED, by City Council of the City of Middletown, Butler/Warren Counties, Ohio, that: Section 1 The City Manager is hereby authorized to create a Pilot Program to incentivize the construction of new housing in an effort to balance the housing stock available in the City. A. The City Manager may agree to waive the building and construction permit fees and water and sewer tap-in fees charged by the City on the construction of up to five (5) new single family homes in the Middletown City School District who are under contract before December 31, 2016. B. All construction is subject to local and state standards. Section 2 The City Manager is hereby authorized to waive building and construction permit fees and water and sewer tap-in fees in accordance with the Pilot Program outlined in Section 1 of this Ordinance without further action by City Council. Section 3 This ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and general welfare, to wit: to provide immediate economic incentives to address existing issues in the housing stock balance and shall take effect and be in force from and after its adoption.

Why does encouraging the growth of new housing stock have to be legislated? Why does council have to vote on this? If the city leaders would create an environment where there was potential for the PRIVATE SECTOR builders to see opportunity, this would happen automatically in the PRIVATE SECTOR free market of supply and demand. Improve the city environment as to desirability and it will happen automatically. New slant on residential attraction......if you improve the quality and image of the town, the builders will be around.

Again, just as with the city purchasing real estate for sale (Thatcher properties/Rose Building, the whole downtown as examples) and development, the city just can't distinguish between where public sector responsibilities end and where private sector responsibilities begin. It is not government's business to be involved in private sector affairs. Let the market dictate the action and stop forcing the issue. They haven't learned a thing from their claim to get out of the real estate business using our taxpayer money as they promise over and over again to stop the practice, yet it continues to this day. We are a cash strapped city according to city hall people. No business spending what little revenue we have on real estate owned by the city nor giving out business loans. Millions in taxpayer money spent in the downtown area alone. Should have all been private sector money used. Some business owners have never paid their city loans back. You would have thought that given the poor record of resale (reference the Manchester Hotel and the Studio Theatre as examples), that they would have learned their lesson by now.......but, then we must realize who's been running this town for the last three decades and we have our answer. Mistake after mistake made over the decades. Sad.
I'm so proud of my hometown and what it has become. Recall 'em all. Let's start over.

Oh, yeah, I almost forgot.......there is that little thing in attracting new residents which involves a quality school system. Middletown schools have a well-earned reputation of being one of the poorest performers in the state. That's not helping either, especially when no one is convinced that the situation will ever improve. Just building houses won't do the trick. Gotta offer decent schools and quality of life benefits too.
I'm so proud of my hometown and what it has become. Recall 'em all. Let's start over.
