Middletown City Schools are still fighting for the land in Franklin, Ohio. Different lawyers for the Middletown City Schools have said that the districts appeal in a land transfer case is an opportunity for courts to interpret the law in a way that could save urban school districts in the state.
The first requested transfer was 1,600 acres of land east of Interstate 75 from Franklin City Schools in August 2005. The dispute over land includes Atrium Medical Center campus and is within Middletown city limits. The request for the land was denied by the Ohio State Board of Education and Franklin County Common Pleas Court.
Now Middletown has appealed in the 10th District Court of Appeals in Columbus. There was arguing along with many other things, the law is made to allow districts to grow and adjust with their changing communities.
The State Board of Education and Franklin City Schools have 20 days from the date that Middletown filed its brief to submit arguments. There will be a panel of three judges that will decide to hear the arguments or review the briefs and make a ruling.
