Lawyers for Franklin Schools Speak About Land Transfer Case |

Lawyers that are for Franklin schools say that Middletown’s claim that the land transfer case is about saving urban schools is “bizarre and alarmist.” The dispute over 1,600 acres east of Interstate 75 has been going on for four years.
Right now Middletown is appealing the decision to deny the request in the 10th District Court Appeals in Columbus. There will be three judges determining whether a lower court abused its discretion when it upheld the Ohio State Board of Education’s decision to deny the transfer.
According to Franklin schools the state board has filed their responses to Middletown’s arguments. Both of the parties agree and the appeals judges should only consider whether the lower court abused its discretion, and there is no evidence it did.
Due to financial difficulties Middletown’s claim was delayed for the transfer case. It came up with the creation of the Monroe school district. According to the court docket December 15th is the deadline for Middletown to reply.
