As much as we need the jobs that this could bring,these fools are worried about a dumpster and smoking area? UNBELIEVABLE !
Not to mention being handy for our areas veterans.

MIDDLETOWN — Planning Commission members stuck to the city’s zoning requirements Wednesday night, Jan. 13, approving a Veterans Affairs medical center without a pair of heavily-debated variances.

The commission approved the medical center on a 4-1 vote, but declined to grant variances allowing a smoking shelter and Dumpster to remain on the northern side of the development.

Planning Director Marty Kohler said he felt the commission could potentially have been setting a dangerous precedent by granting variances without proper justification.

“I still believe it’s simply a design challenge with respect to the smoking shed and Dumpster,” Kohler said. “In my opinion they need to get creative in figuring out where to put (them).”

The 18,670-square-foot medical office building will occupy a 3.83-acre lot in 4300 block of Union Road, approximately 100 feet south of the Inn at Renaissance Village.

Commission members approved a combined preliminary and final development plan for the center with several modifications: relocating commercial trash containers and a smoking shelter to the west side of the building; the construction of temporary access to Union Road until it is widened; and mounding and landscaping along the east side of the property will be confined to a 15-foot strip between the parking lot and right-of-way.

Commission member Tony Marconi said he thought the group was “doing the right thing” by not granting any variances for the development.

“I don’t want to hold the project up, so to me this is the best solution tonight,” Marconi said. “We’re saying we’ll approve it with the developer putting the trash and smoking areas someplace else.”

Ann Lubbers, design associate with developer Al Neyer, said relocating the Dumpster and smoking hut to the west property line could force them to expand the site by purchasing neighboring space. Additionally, she said the move would encroach on a planned access point and could create an eyesore for neighboring businesses.

“It would eliminate some of the connectivity of this whole development,” Lubbers said.

Kohler and his little committee seem to have made a decision that could force this developer to spend more money on the site and, based on the statement above, create an undesirable situation for the neighboring businesses. ........If true, why would the Planning Commission make this decision if the plan for the city is to be "business friendly"? Is this decision based on actual site development rules or ordinances or is this decision based on the whims, "development tastes" and ideas of the committee members???( Kohler: " IN MY OPINION, they need to get creative in figuring out where to put them") Is this another example of city hall throwing every roadblock they can in front of the few businesses that are trying to start up in this town? If so, Kohler and others need to leave town now.

Have to agree with you Vet.Kohler and his follower's need to be escorted out of town. If they (city so called leaders) dont stop his stupid act's the city will never become "bussiness friendly" as they seem to say .I think that patch of carpet on his head has effected his way of thinking.Big%20smile

Sounds like to me they are trying to force the business to purchase an additional lot just for smoking & a dumpster.
 
But I'm with you guys,how in the world could this even be an issue ?!!!

Actually, I believe the VA could just NOT have a Smoking Area and just allow smoking anywhere outside. Federal Facilities are exempt from State Regs, so the Smoking Law does not apply. I might if I were the Fed in Charge just for spite. They smoke up a Storm at the Dayton VA.

I hate to sound like a kook or a nutty conspiracy theorist, but it sounds as if, from The Journal article, Kohler and Marconi were the most adamant about focing a change that would mean:  "relocating the Dumpster and smoking hut to the west property line could force them to expand the site by purchasing neighboring space."
 
I wonder who would profit by the forced purchase of the property to the west???
