Officials: Petitions valid for Ohio mayoral recall

AKRON, Ohio — Officials say critics of a northeast Ohio mayor have collected enough valid signatures to force a recall election.

The Summit County Board of Elections says the group Change Akron Now collected 3,800 valid signatures, hundreds more than necessary to force a recall vote on Mayor Don Plusquellic (pluhs-KWEHL'-ihk).

The group fell short in its first petition drive but submitted nearly 2,000 more signatures this week. If the clerk of Akron City Council also verifies the petitions, the council would set an election within two months.

Plusquellic has been mayor for 23 years and has said he will fight the recall effort.

The Democrat's opponents accuse him of running up the city's debt.

I don't see any difference between this and mis-use of funds!!

On this beautiful Mother's Day, my fervent prayer is that GOD will provide a way for open, honest, cost-effective and non-elitist government to return here in Middletown, Ohio, USA.  GOD bless us all.

409- The article says the mayor will fight it. Wonder how, if the people have enough valid signatures and will vote again to replace the guy? What are his options if the people don't want him? Second comment- to all here who post- When are we all going to meet to discuss setting up a program to obtain the recall forms, organize volunteers to gather signatures and return them to the Elections Board? Don't we need to get the ball rolling to oust the Council and School Board? How about all gathering at Golden Corral for a Saturday breakfast and a meeting? Anybody?

Good Morning Viet Vet -

Count me in as I'm already one of the "10 Most Wanted And Dangerous Whistleblowers" who previously worked for the City of Middletown!  Now that I think of it, that title is a badge of honor!  Maybe the local print media will hire me to provide "fair and honest reporting?"  What a refreshing change that would be!

Naw- the local media ( referring to the Journal) hasn't had fair and honest reporting for a long time. (since, at least the 80's- probably further back than that) They don't want fair and honest as it would infuriate the city government and some of the so-called "high rollers" in town. The last time the Journal was a quality paper was when it was run by hometown people. When outsiders took over,were bought and paid for by AK, the city government, select influential club members ( Mort, Thatcher, Blake, SpiderJohn, Mike Presta and others) and the school board, it went down the tubes in quality of reporting. All one sided now.

Hey! Did you catch the influential list Spider and Mike? Just kidding of course!!    Just a little humor on Mother's Day!!!

I just spoke with an employee of Neighborhood Housing Services (NHS).  This is the non-profit housing counseling agency that just closed its' Central Avenue location that I recently reported.
 
It seems that a prominent local print media representative called NHS last Friday to verify if my information was accurate.  Well, it seems that the former CD Administrator (RESIGNED??) told the truth!  I doubt that this confirmation of his honesty will do anything to encourage our local BEACON OF TRUTH to tell the sad story about HUD-funded programs in Middletown??  I can only hope and pray for the best.

Third Ohio City Proposes Camera Ban
Residents in Chillicothe, Ohio formally circulate an initiative petition designed to ban photo ticketing in the city.

Chillicothe%20speed%20cameraIn the wake of an Ohio supreme court decision favoring the use of speed cameras and red light cameras, residents of Chillicothe are looking to become the third community to take matters into their own hands. The group Citizens Against Photo Enforcement announced the filing of a formal initiative petition this week that would offer a vote in November on whether to ban photo ticketing completely.

The initiative's sponsors believe they can gather the 800 signatures required to put the question to voters in the city of 22,000. An informal online petition already gathered the support of 3416 area residents, which represents nearly one out of every five registered voters. If successful, the measure would repeal the city ordinance authorizing cameras and prohibit any similar ordinances from being adopted in the future. The measure also bans contracting out photo ticketing services to a private company and ensures anyone charged with a civil or administrative traffic fine has the full protection of due process under "state, federal, or common law as may apply."

According to petition proponents, Chillicothe's red light cameras have been placed at intersections with just 3.0 seconds of yellow warning time. Under a 2008 state law, it is illegal for any camera-equipped intersection to have a yellow time duration of less than 4.0 seconds (Ohio Code Section 4511.094). Proponents are also disturbed by the speed cameras that have been ticketing at a rate of at least 300 citations per day with 70 percent of the profit generated sent to Redflex Traffic Systems in Australia.

Last month a bipartisan coalition led a
successful initiative effort banning cameras 100 miles west in Cincinnati. In 2006, three out of every four voters in Steubenville chose to kick out speed cameras after the devices had issued $600,000 in citations. Over the past twelve years, voters in Anchorage, Alaska; Peoria, Arizona and Batavia, Illinois have also banned cameras.

AN ORDINANCE RESTRICTING USE OF MOBILE SPEED ENFORCEMENT VEHICLES AND TRAFFIC LAW PHOTO-MONITORING DEVICES AND REPEALING ORDINANCE NUMBER 151-07 AND CHAPTER 315 OF THE REVISED ORDINANCES OF CHILLICOTHE, OHIO

BE IT ORDAINED by the electors of the City of Chillicothe, as follows:

Section 1: The City of Chillicothe, including its various boards, agencies and departments, shall not use any traffic law photo-monitoring device or mobile speed enforcement vehicle for the enforcement of a qualified traffic law violation, unless a law enforcement officer is present at the location of the device or vehicle and personally issues the ticket to the alleged violator at the time and location of the violation.

Section 2: Definitions. As used in this Ordinance:

a. "Law enforcement officer" means any law enforcement officer employed by the City of Chillicothe or by Ross County.

b. "Qualified traffic law violation" means a violation of any of the following: (1) any state or local law relating to compliance with a traffic control signal or a railroad crossing sign or signal; or (2) any state or local law limiting the speed of a motor vehicle.

c. "Ticket" means any traffic ticket, citation, summons, or other notice of liability, whether civil, criminal, or administrative, issued in response to an alleged qualified traffic law violation detected by a traffic law photo-monitoring device.

d. "Traffic law photo-monitoring device" means any electronic, photographic, video, radar, laser or digital system used to produce evidence of an alleged traffic violation and/or the identity of the operator of any motor vehicle.

e. "Mobile speed enforcement vehicle" means any vehicle that uses any electronic, photographic, video, radar, laser or digital system to produce evidence of the speed of motor vehicles or the identity of the operator of any motor vehicle.

Section 3: Chillicothe Ordinance Number 151-07, Chapter 315 of Revised Ordinances of Chillicothe, Ohio, and any ordinance implementing either that may be enacted prior to the passage of this Ordinance, are hereby repealed, void, and of no effect. The City shall not hereafter enact or enforce any ordinance that conflicts with this Ordinance. In the event that any provision of this Ordinance is found to be unconstitutional or impermissibly in conflict with state or federal law, only such provision found to be unconstitutional or impermissible will be stricken, and the remainder of this Ordinance will remain in full force and effect.

Section 4: The City shall not be a party to any contract for the installation of any traffic law photo-monitoring device or mobile speed enforcement vehicle if payment to the vendor or installer is contingent on the number of tickets issued or fees collected. Any such contract is hereby declared to be void for illegality.

Section 5: In any civil proceeding for the enforcement of any traffic law violation, the alleged violator is entitled to the benefits of the procedures set forth in the Ohio Rules of Civil Procedure, in Title 23 of the Ohio Revised Code, and in the Ohio Rules of Evidence.

Section 6: In any administrative proceeding for the enforcement of any traffic law violation, the alleged violator is entitled to the benefits of the procedures set forth in Title 119 of the Ohio Revised Code and in the Ohio Rules of Evidence.

Section 7: Notwithstanding the provisions of Sections 4 and 5, alleged traffic violators in any civil or administrative traffic proceeding are also entitled to the benefits of such other sections of state, federal, or common law as may apply.

If it is a state law concerning the timing of 4 seconds on the yellow light, Middletown has several lights that have less than the 4 second requirement. If we all decide to do the recall thing with the Council and School Board, and we're walking around getting the signatures, why not include getting signatures to repeal the red light cameras here in town and follow Chillicothe's lead? Might as well tackle all the issues with one go around asking the voters to sign.

Forget it fellow soldiers---too much work--too much apathy--too many legal obstacles created by Admin and legal.
 
Just concentrate on the up-coming ward elections. I have been working to inspire like-minded quality candidates from each ward., however only one person has shown interest
If we can't find new qualified insipring candidates, then replacing the current group is not so vital. That is the simplest most effective and complete way to bring about quick change. Plus voting down all tax levys and even a few select renewals. If they won't change to be mopre open and inclusive, then we can starve the beaqst to force him to the table.

You MIGHT have them ready by the Nov.elections--then what happens?
Re-call Council members who are running for election and the others?
 
A waste of time that could be much better utilized imo.

HOWEVER--WHO ARE YOU TO TARGET?
ALL OF THEM?
WHY TARGET THOSE UP FOR ELECTION IN 6 months?
maybe Mr.Becker will be chosen for the EMA position, for which he is very well qualified, and could be extremely helpful to our community.
 
I just don't see enough community support to make a re-call effort worthwhile or successful.
Either way--you still need better replacements.

Spider let the current election play out.
 
Schiavone is leaving.
Marconi has an opponent.
Becker may or may not be leaving?  He has an opinion from the AG that states he can stay if he likes.
Ford has some competition.
Armbruster needs some competition.
 
The question is who are these people running against Schiavone, Marconi and Ford?  Anyone want fill those of us in, who don't know them.
 
Depending on what a group of citizens wants to do, Change the Charter, Change some ordinances, or recall some elected officails this can be done once the dust settles and we see where things stand.

Last summer and fall three City Council members often told a City employee that they were working hard to gain the support of Bill Becker to oust a senior level City of Middletown administrator.  One of these persons lamented the fact that they were on the search committee that played a major role in the hiring of this key governmental official.  Maybe these City Councilors have developed AMNESIA of late???
