II. LEGISLATION


1. Ordinance No. O2009-29,
an ordinance providing for the construction of certain public
improvements within the City by creating a Tax Increment Financing Area encompassing certain
parcels of real property, declaring improvements to such parcels to be a public purpose, exempting
such improvements from taxation, requiring the owners of such parcels to make service payments
in lieu of taxes, providing for the Butler County Treasurer to distribute service payments to the
Middletown City School District in the amount that the district would otherwise receive absent the
exemption, establishing a Municipal Public Improvement Tax Increment Equivalent Fund for the
deposit of the remainder of such service payments describing the public infrastructure
improvements made, to be made or in the process of being made by the City that directly benefit, or
that once made will directly benefit, those parcels, and approving and authorizing the execution of
Tax Increment Financing Agreement. (2nd Reading)

2. Ordinance No. O2009-3
0, an ordinance authorizing a contract with J. W. Devers & Son, Inc. for the
purchase of equipment to be mounted on a single axle truck. (2nd Reading)

3. Ordinance No. O2009-31,
an ordinance authorizing a contract with J. W. Devers & Son, Inc. for the
purchase of equipment to be mounted on a tandem axle truck. (2nd Reading)

4. Ordinance No. O2009-32,
an ordinance authorizing a contract with J. W. Devers & Son, Inc. for the
purchase of equipment for two new trucks. (2nd Reading)

5. Ordinance No. O2009-33,
an ordinance authorizing a contract with Cummins Bridgeway, LLC for
replacement of engines in six city transit buses. (2nd Reading)

6. Ordinance No. O2009-34,
an ordinance establishing a procedure for and authorizing a contract
with CONSOC Housing Consultants for the purpose of administering the Housing Choice Voucher
Program. (2nd Reading)

7. Ordinance No. O2009-35,
an ordinance adopting and implementing the procedures set forth in
Sections 5722.02 to 5722.15 of the Ohio Revised Code to facilitate the effective revitalization of
non-productive land situated in the City. (2nd Reading)

8. Ordinance No. O2009-36,
an ordinance authorizing the City Manager to enter into a Local Project
Authority Agreement with the Ohio Department of Transportation for the resurfacing of a portion of
Sutphin Street and declaring an emergency.

9. Ordinance No. O2009-37,
an ordinance authorizing the City Manager to enter into a Local Project
Authority Agreement with the Ohio Department of Transportation for the resurfacing of a portion of
University Boulevard and declaring an emergency.

10. Ordinance No. O2009-38,
an ordinance amending Section 452.03 of the Codified Ordinances to
prohibit the parking of vehicles in front yards and side yards. (1st Reading)

11. Ordinance No. O2009-39,
an ordinance establishing a procedure for and authorizing a contract
with TV Middletown. (1st Reading)

12. Ordinance No. O2009-40,
an ordinance approving an agreement with Pledger Orthopedic & Spine
Center for the construction of a new facility as a development project and tax exemption pursuant to
the State Urban Jobs and Enterprise Zone Program, and making determination therewith. (1st
Reading)

an ordinance authorizing a Development Agreement with Pledger
Orthopedic & Spine Center. (1st Reading)

III. EXECUTIVE SESSION –
under the authority of O.R.C. 121.22(G)(1) to consider the appointment
of a public employee or official and under the authority of O.R.C. 121.22(G)(2) to consider the purchase
of property for public purposes.

IV. REOPEN MEETING –
